Christa Gail Pike remains in critical condition, unconscious, intubated and on a ventilator following Tennessee’s failed attempt to execute her by lethal injection, according to a new court filing submitted by her attorneys.

“As of last night, October 1, 2026, Ms. Pike remains critically ill and is being treated at a Nashville-area hospital. She is intubated, on a ventilator, and remains unconscious,” her legal team wrote in the filing.

The filing represents the most serious update yet on Pike’s condition since she survived Tennessee’s September 30 execution attempt after receiving two doses of pentobarbital.

Attorneys Ask Court to Preserve All Evidence

Pike’s lawyers are now asking a court to order the preservation of “any and all evidence” connected to the failed execution.

The request includes materials from inside the execution chamber and other records that could help determine what happened during the procedure, as questions continue over intravenous access, drug administration and the state’s response after Pike remained alive.

The legal team argues that the evidence could be critical to future litigation over the execution attempt and any possible effort by Tennessee to schedule another execution.

Filing Describes Severe Injuries to Pike’s Arms

According to the filing, Pike arrived at the hospital with both arms described as “swollen, burned, and blistered.”

Her attorneys say hospital staff have been working to stabilize her condition, save her life and clear pentobarbital from her system.

The filing also raises concerns that the IV lines used during the execution may not have been properly placed.

Pike’s lawyers suggest that some of the pentobarbital may have entered surrounding tissue rather than flowing directly into her veins. That remains an allegation from her legal team and has not yet been established by an independent investigation.

Two Doses Failed to Cause Death

Tennessee uses a single-drug lethal-injection protocol involving pentobarbital.

During Wednesday night’s execution attempt, officials administered both the primary and backup doses authorized under the protocol.

Pike nevertheless remained alive.

She was later transported from Riverbend Maximum Security Institution to a Nashville-area hospital for emergency medical treatment.

The Tennessee Department of Correction has said officials followed the state’s established execution procedures.

Evidence Preservation Could Shape Future Legal Fight

The new filing signals that Pike’s attorneys are preparing for a broader legal challenge over what happened inside the execution chamber.

Evidence involving IV placement, medical monitoring, drug administration, witness observations, surveillance records and internal state communications could become central to determining whether Tennessee’s procedure was carried out properly.

The preservation request could also become important if the state later seeks another execution date.

Pike’s legal team has already argued that forcing her to undergo a second execution attempt after surviving the first could raise serious constitutional questions under the Eighth Amendment’s prohibition against cruel and unusual punishment.

Independent Review Already Underway

Gov. Bill Lee has ordered a comprehensive independent review of Tennessee’s execution procedures and halted the state’s remaining scheduled execution for 2026.

The investigation is expected to examine what happened during Pike’s execution attempt and why two prescribed doses of pentobarbital failed to cause her death.

For now, Pike remains hospitalized in critical condition, and her attorneys say there is still no clear prognosis for her recovery.

The case has now moved beyond a failed execution itself and into a new phase focused on medical evidence, state accountability and the legal consequences of what occurred inside Tennessee’s execution chamber.
