The Trump administration has appealed a federal court order requiring the government to continue payments for the $16 billion Hudson Tunnel Project, reopening a major funding dispute over one of the most important transportation projects connecting New Jersey and New York.
The Hudson Tunnel Project is part of the broader Gateway Program and includes construction of a new passenger rail tunnel beneath the Hudson River between New Jersey and Manhattan, followed by rehabilitation of the existing North River Tunnel.
The current tunnel is more than a century old and was heavily damaged by saltwater flooding during Hurricane Sandy. It remains a critical rail connection used by Amtrak and NJ Transit trains traveling between New Jersey and New York.
Federal funding for the project was suspended in October 2025. The Gateway Development Commission later filed suit against the U.S. Department of Transportation, arguing that the federal government was legally obligated to continue payments under funding agreements already in place.
Construction was temporarily suspended in February after funding ran short, affecting nearly 1,000 jobs, but resumed later that month after the federal government released previously withheld payments.
A federal judge subsequently ordered the payments to continue. The Trump administration is now appealing that ruling, keeping uncertainty over the long-term financing of the project alive.
The project had secured roughly $15 billion in federal support during the Biden administration. Approximately $2 billion has already been spent, according to Reuters.
The funding battle is especially significant for New Jersey commuters because the existing Hudson River rail connection is one of the most heavily used sections of the Northeast Corridor. Gateway officials have warned that another funding interruption could again force construction delays.
Despite the dispute, work on the project has continued. The Gateway Development Commission has awarded major construction contracts this year, including work on the Hudson River tunnel section and the New Jersey surface alignment.
The administration’s appeal does not immediately cancel the Hudson Tunnel Project. Instead, it challenges the court order requiring the federal government to continue releasing funds while the broader legal dispute moves forward.
