NEW JERSEY — The New Jersey Department of Human Services has extended the public comment period on proposed guidelines introducing stronger financial penalties and enforcement measures for organizations providing services to adults with intellectual and developmental disabilities.
Residents, families, caregivers, advocates, and service providers now have until Tuesday, October 13, at 5 p.m. to submit their comments.
The initiative aims to strengthen accountability, improve safety standards, and protect some of New Jersey’s most vulnerable residents.
Stronger Penalties for Violations
The new law, P.L. 2025, Chapter 280, took effect on July 1, 2026, expanding the state’s authority to impose administrative and financial penalties on service providers that fail to meet legal requirements.
Violations that may result in penalties include:
- Abuse, neglect, or exploitation of individuals receiving care.
- Failure to report suspected abuse or serious incidents.
- Inadequate internal investigations.
- Failure to conduct required employee background checks.
- Operating without required licenses or certifications.
- Failure to comply with health and safety requirements.
The law allows state officials to impose financial consequences in addition to existing enforcement measures, including corrective action requirements and licensing oversight.
Protecting Adults With Disabilities
The new enforcement framework applies to licensed residential programs, authorized developmental disability service providers, and organizations operating without required state approval.
The Department of Human Services says the changes are intended to improve oversight and ensure that individuals receiving support are treated with dignity and protected from preventable harm.
The proposed guidance explains how penalties will be assessed and how the state plans to implement the law while formal regulations are being developed.
Public Invited to Share Feedback
The Department initially set a September 29 deadline for public comments but extended it to October 13 to provide additional time for review.
Families of individuals receiving services, disability rights organizations, care workers, and members of the public are encouraged to participate.
Feedback may help shape the final guidance governing how the department investigates violations and applies penalties.
Comments must be submitted by 5 p.m. on Tuesday, October 13.

A Step Toward Greater Accountability
The expanded enforcement authority reflects New Jersey’s efforts to strengthen protections for adults with intellectual and developmental disabilities.
By establishing clearer consequences for serious violations, state officials aim to encourage better compliance, improve provider accountability, and reduce risks to individuals who depend on these services.
The public comment period gives residents and organizations an opportunity to participate in shaping how the new rules will be enforced.
